1. Acceptance of Terms

By using SpeakAI, you agree to comply with and be legally bound by these Terms of Use and all applicable laws and regulations. If you do not agree to these terms, please do not use our app.

2. Use of the App

• You must be at least 13 years old to use SpeakAI.
• You agree to use the app only for lawful purposes and in accordance with these Terms of Use.
• You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device.

3. Subscriptions, Billing and Refunds

SpeakAI offers subscription plans ("Subscriptions") that provide access to premium features. By subscribing, you agree to the following:

• Billing: Subscriptions are processed through the Apple App Store or Google Play Store. You will be charged according to the plan you selected.
• Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it at least 24 hours before the renewal date.
• Refunds: All refund requests must be handled through the respective app store (Apple or Google). SpeakAI does not directly process refunds for app store purchases.

4. Intellectual Property

All content, features, and functionality of SpeakAI, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of SpeakAI or its licensors and are protected by copyright, trademark, and other intellectual property laws.

5. User Content

By submitting any content (including speech, text, or other materials) to SpeakAI, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content for the purpose of providing and improving our services.

6. AI Data Processing

We use third-party AI services to analyze user input (such as voice recordings and text). The data may be transmitted to:

• OpenAI
• Google
• Other AI providers

Purpose:

• Speech evaluation
• Personalized feedback
• Learning recommendations

We do NOT use your data for advertising or resale. You can withdraw consent anytime in Settings.

7. AI Service Disclaimer and Accuracy

SpeakAI utilizes advanced AI technology to provide language coaching. However, you acknowledge that:

• AI-generated content may occasionally be inaccurate, incomplete, or offensive.
• SpeakAI does not guarantee the accuracy of translations, grammar corrections, or cultural advice provided by the AI.
• The AI services are provided for educational purposes "as is," and you should not rely on them for critical or professional communications without verification.

8. Account Deletion

You may delete your account at any time via the "Delete Account" option in the App settings. Upon deletion, all your user data will be permanently removed from our servers.

9. Prohibited Conduct

• You may not use the app in any way that could damage, disable, overburden, or impair our servers or networks.
• You may not attempt to gain unauthorized access to any part of the app, other accounts, or computer systems or networks connected to the app.
• You may not use the app for any unlawful or prohibited purpose.

10. Termination

We reserve the right to suspend or terminate your access to SpeakAI at any time, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users of the app, us, or third parties, or for any other reason.

11. Disclaimer of Warranties

SpeakAI is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation or availability of the app or the information, content, or materials included therein.

12. Limitation of Liability

To the fullest extent permitted by law, SpeakAI and its affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the past twelve months.

13. Dispute Resolution and Binding Arbitration

Most concerns can be resolved by contacting us. If a dispute cannot be resolved, you agree to resolve it through binding arbitration in the jurisdiction of SpeakAI's operation, rather than in court, except for claims that qualify for small claims court.

14. Changes to Terms

We may revise these Terms of Use at any time without notice. By continuing to use the app after such changes, you agree to be bound by the revised terms.

15. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of our primary operating jurisdiction, without regard to its conflict of law provisions.
